The paper discusses the historical roots of the political cultures of Japan and China by examining the principal characteristics of their traditional Imperial systems. Comparison of the logic of legitimacy in each case, namely divine lineage in Japan in contrast to the awesome but demanding Mandate of Heaven in China, highlights the philosophical difference between reigning and ruling, and the consequences of this for modem politics in each country. A sacral aura still surrounds the Japanese system tending to insulate authority (...) from the kind of pressures that could lead, in China, to the loss of the Mandate, most recently based on socialist ideals. The paper argues from the premise that myth is diverse in purpose, intent, form and content to the conclusion that myth may not be irrelevant in a culture in which the paradigm of knowledge is the scientific hypothesis. By contrasting structural similarities and common features, it is claimed that the relationship between myth and scientific hypothesis should be conceived logically rather than chronologically. While Montesquieu’s The Spirit of Laws is recognized as one of the foundational philosophical works on the subject of liberty, much work still needs to be done to ferret out exactly what Montesquieu’s teaching is on the subject. This essay attempts to contribute to this endeavor by clarifying certain key elements of Books 11 and 12 of that book.

In the context of the widening trade gap between Japan and the U.S.A. and the increasing numbers of missions visiting Japan aimed at a better understanding of the Japanese market and Japanese business, topics such as Just in Time and TQC have received the most prominence, along with discussions of Japanese-style management and labor relations. The weakness of most discussions has been their inability to set these into the context of the highly complex Japanese value-system that runs through both business (...) and society. Once understood, it becomes apparent that there is a system of values and value-related strategies at work that have a re-inforcing effect in the directions of cooperation and efficiency. The paper will identify a number of these and indicate their areas of influence. Notwithstanding its long history, libertarianism became intellectually respectable within academe with the publication of Robert Nozick's Anarchy, State, and Utopia. More or less starting with the claim that, "Individuals have rights, and there are things no person or group may do to them," Nozick's book attempts to argue that a minimal state "limited to the narrow functions of protection against force, theft, fraud, enforcement of contracts, and so on" is morally justifiable, and that a more extensive state violates the rights (...) of individuals and is thus morally stained. Respectability, however, did not forestall criticism, and Anarchy, State, and Utopia was attacked from all fronts. Philosophically, perhaps the most damaging critique came from Thomas Nagel, for he argued that Nozick had erected "Libertarianism without Foundations." Libertarianism as Nozick crafts it is without foundations because he provides little by way of justification for the strong theory of rights that drives this political philosophy and, as such, drives the minimalist conception of state and conception of free markets that constitute it. Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. BackgroundCentral to ethically justified clinical trial design is the need for an informed consent process responsive to how potential subjects actually comprehend study participation, especially study goals, risks, and potential benefits. This will be particularly challenging when studying deep brain stimulation and whether it impedes symptom progression in Parkinson’s disease, since potential subjects will be Parkinson’s patients for whom deep brain stimulation will likely have therapeutic value in the future as their disease progresses.MethodAs part of an expanded informed consent process (...) for a pilot Phase I study of deep brain stimulation in early stage Parkinson’s disease, an ethics questionnaire composed of 13 open-ended questions was distributed to potential subjects. The questionnaire was designed to guide potential subjects in thinking about their potential participation.ResultsWhile the purpose of the study (safety and tolerability) was extensively presented during the informed consent process, in returned responses 70 percent focused on effectiveness and 91 percent included personal benefit as potential benefit from enrolling. However, 91 percent also indicated helping other Parkinson’s patients as motivation when considering whether or not to enroll.ConclusionsThis combination of responses highlights two issues to which investigators need to pay close attention in future trial designs: (1) how, and in what ways, informed consent processes reinforce potential subjects’ preconceived understandings of benefit, and (2) that potential subjects see themselves as part of a community of Parkinson’s sufferers with responsibilities extending beyond self-interest. More importantly, it invites speculation that a different paradigm for informed consent may be needed. (shrink)

HIV remission clinical researchers are increasingly seeking study participants who are diagnosed and treated during acute HIV infection—the brief period between infection and the point when the body creates detectable HIV antibodies. This earliest stage of infection is often marked by flu-like illness and may be an especially tumultuous period of confusion, guilt, anger, and uncertainty. Such experiences may present added ethical challenges for HIV research recruitment, participation, and retention. The purpose of this paper is to identify potential ethical challenges (...) associated with involving acutely diagnosed people living with HIV in remission research and considerations for how to mitigate them. We identify three domains of potential ethical concern for clinicians, researchers, and ethics committee members to consider: 1) Recruitment and informed consent; (2) Transmission risks and partner protection; and (3) Ancillary and continuing care. We discuss each of these domains with the aim of inspiring further work to advance the ethical conduct of HIV remission research. For example, experiences of confusion and uncertainty regarding illness and diagnosis during acute HIV infection may complicate informed consent procedures in studies that seek to recruit directly after diagnosis. To address this, it may be appropriate to use staged re-consent procedures or comprehension assessment. Responsible conduct of research requires a broad understanding of acute HIV infection that encompasses its biomedical, psychological, social, and behavioral dimensions. We argue that the lived experience of acute HIV infection may introduce ethical concerns that researchers and reviewers should address during study design and ethical approval. (shrink)

Trypanosoma brucei mitochondria contain unusual small circular DNAs of unknown function. These are catenated with a long informational DNA sequence containing genes homologous to those found in other mitochondria. Although these genes are transcribed throughout the life cycle, differential production of the mitochondrial respiratory system during the life cycle is accompanied by differential abundance of specific transcripts and differential polyadenylation of mitochondrial gene transcripts. Multiple transcripts occur for most of the mitochondrial genes. Transcripts of the apocytochrome b gene possessing nucleotide (...) sequences at their 5′ ends which are not present in mitochondrial DNA are found at stages of the life cycle when the respiratory system is expressed. These results suggest the presence of post‐transcriptional mechanisms that regulate the expression of mitochondrial genes during the life cycle of T. brucei. (shrink)

ABSTRACTOne long-running conundrum in Husserlian phenomenology revolves around the question of the identity of what Husserl calls the transcendental ego, a mysterious figure that he identifies as the subject of a genuinely transcendental phenomenology. In dialogue with both Husserl and his assistant and collaborator Eugen Fink, I attempt in this article to give a solid account of the identity of this transcendental ego, and in particular to explain the connection between this figure and the empirical ego of the individual phenomenologist. (...) I make particular reference to Fink's depiction of a "personal union" between these two egos in his Sixth Cartesian Meditation and to certain unclear hints in Husserl's 1923/1924 lectures on First Philosophy. Ultimately, I develop my own account of such a union, which explains the transcendental ego as a certain mode in which the phenomenologist might investigate his own experiences. On this basis, I argue, the status of phenomenology as a transcendental discipline can be understood without subjecting that discipline to certain criticisms that have been levelled against it. Purpose This paper aims to formalize long-term trajectories of human civilization as a scientific and ethical field of study. The long-term trajectory of human civilization can be defined as the path that human civilization takes during the entire future time period in which human civilization could continue to exist. -/- Design/methodology/approach This paper focuses on four types of trajectories: status quo trajectories, in which human civilization persists in a state broadly similar to its current state into the distant future; catastrophe (...) trajectories, in which one or more events cause significant harm to human civilization; technological transformation trajectories, in which radical technological breakthroughs put human civilization on a fundamentally different course; and astronomical trajectories, in which human civilization expands beyond its home planet and into the accessible portions of the cosmos. -/- Findings Status quo trajectories appear unlikely to persist into the distant future, especially in light of long-term astronomical processes. Several catastrophe, technological transformation and astronomical trajectories appear possible. -/- Originality/value Some current actions may be able to affect the long-term trajectory. Whether these actions should be pursued depends on a mix of empirical and ethical factors. For some ethical frameworks, these actions may be especially important to pursue. (shrink)

These questions are important for our understanding of not only the historical development of phenomenology but also the practice and goals of phenomenology—specifically, for a conception of phenomenologizing as a project in which we, as particular, historical, empirical figures, might want to engage.Much of the book focuses on laying the groundwork for understanding these complicated issues both historically and systematically. Džanić does an admirable job of tracing the rapidly evolving interactions between Husserl and Fink, both as intellectual collaborators on this philosophical project and as a pair of very human figures who ultimately found themselves pursuing quite different solutions to the problems of the subject and origin of phenomenology. He focuses particularly on the Sixth Cartesian Meditation, Fink’s attempt to extend Husserl’s famous text to include a phenomenology of the act of phenomenologizing itself (including Husserl’s marginal comments on the text), although he draws on a number of other significant texts and manuscripts (mostly Husserl’s, albeit with an extended aside on Heidegger) wherever they are helpful for explicating the complex evolution of Husserl’s thought on the subject. Admittedly, the book thus takes on a challenging task—both because of the difficult nature of this topic and because of the obscurity of the technical terms required to discuss it. However, despite the necessarily enigmatic character of the relevant language, Džanić’s attempts to explore the main outlines of this issue are worthwhile, particularly due to his ability to resist the temptation to view Husserl’s thought here as monolithic.In the early chapters, Džanić explicates in detail the rather complicated solution that Fink proposed to this difficulty, namely, the abandonment (to some extent) of the ultimately human origin of phenomenology in favor of a fundamentally nonhuman (and eventually meontic) conception of the transcendental ego, which generated a great deal of elaborate and (at least in the Sixth Meditation) inadequately supported speculation. For Fink, both the motivation to phenomenologize and the act of phenomenologizing itself ultimately stem from a source that is fundamentally prior to—in a(n onto)logical rather than temporal sense—any empirical ego or empirical act of phenomenologizing, a source that merely “enworlds” itself (in various complicated senses that Džanić does [End Page 145] an admirable job of clarifying) in the apparently anthropologistic, everyday world of individual phenomenologists. Džanić calls this interpretation of phenomenology Fink’s “epistemological anti-humanism,” and it serves as the basis for one potential (radically anti-Heideggerian but nevertheless somewhat disappointing) solution to the question of why we should phenomenologize at all. As Džanić notes, this solution was at least briefly taken up by Fink’s mentor Husserl himself, although the degree to which Husserl actually endorsed this path beyond the level of a fleeting flirtation remains questionable. Ultimately, as Džanić rightly highlights and as becomes abundantly clear in Husserl’s (often rather scathing) notes on Fink’s Sixth Cartesian Meditation, he abandoned this interpretation.Accordingly, in the later chapters of the book, Džanić traces Husserl’s ultimate development of a quite different solution to the problems of the origin and motivation of phenomenology—a solution that, unlike his brief foray into Finkian grandeur, views the act of phenomenologizing as essentially rooted in human possibility (that is, as part of the famous lifeworld that features so prominently in Husserl’s work, especially in the Crisis and other late texts). In 2008, researchers reported that Timothy Brown , a man with HIV infection and leukemia, received a stem-cell transplant that removed HIV from his body as far as can be detected. In 2013, an infant born with HIV infection received anti-retroviral treatment shortly after birth, but was then lost to the health care system for the next six months. When tested for HIV upon return, the child had no detectable viral load despite cessation of treatment. The gelsolin gene family encodes a number of higher eukaryotic actin-binding proteins that are thought to function in the cytoplasm by severing, capping, nucleating or bundling actin filaments. Recent evidence, however, suggests that several members of the gelsolin family may have adopted unexpected nuclear functions including a role in regulating transcription. In particular, flightless I, supervillin and gelsolin itself have roles as coactivators for nuclear receptors, despite the fact that their divergence appears to predate the evolutionary appearance of nuclear receptors. (...) Flightless I has been shown to bind both actin and the actin-related BAF53a protein, which are subunits of SWI/SNF-like chromatin remodelling complexes. The primary sequences of some actin-related proteins such as BAF53a exhibit conservation of residues that, in actin itself, are known to interact with gelsolin-related proteins. In summary, there is a growing body of evidence supporting a biological role in the nucleus for actin, Arps and actin-binding proteins and, in particular, the gelsolin family of actin-binding proteins. In his 1922/1923 articles for the Japanese magazine _Kaizō_, Edmund Husserl identifies a particular “humanity” or human culture by the purposeful idea [_Zweckidee_] consciously embraced by the community. This purposeful idea is attained through rational self-formation on the part of the community in a manner analogous to the rational self-formation of the individual human being. Thereafter, it can be referenced to distinguish different cultures (or stages of cultural development) from one another through its objective manifestation in communal groups and cultural (...) products, as Husserl retraces in a historical account of the development of Western history. This paper explores the essential character of this conception of the purposeful idea from both an exegetical and a systematic perspective, examining in particular the relationship between such an idea and the values experienced by individual subjects within a culture (which are, according to Husserl, also available at the level of objective culture in relation to a communal subject). The paper argues that Husserl’s basic conception of the purposeful idea is a good model for understanding certain essential characteristics of cultural constitution in general, although some of his fundamental assumptions—especially the strict identity he attempts to establish between a purposeful idea as such and the specific goal of universal, rational self-understanding—turn out to be somewhat more questionable in light of the connection between the purposeful idea and the genuinely felt values underlying it. Mandating psychiatric evaluation for patients who request physician‐assisted suicide may not offer the clearcut protection from possible coercion or other abuse that proponents assert. Competence itself is a complex concept and determinations of decisionmaking capacity are not straightforward, nor is the relationship between mental illness and decisionmaking capacity in dying patients clearly understood. And casting psychiatrists as gatekeepers in end‐of‐life decisions poses risks to the profession itself.
